Pendulum is a servicing and collections business, and our efforts are focused on collecting amounts due under the loan documents that have been transferred to us on behalf of our clients. Many of these loans were originated by Mexican banks such as Banamex, Bancrecer, Banorte, Capital, Cremi, HSBC, Interestatal, Inverlat, Obrero, Oriente, Serfin, Union, or INFONAVIT, but the legal rights to enforce collection are now owned by one or more of the following companies:
• Corporación para la Recuperación y Utilidad de Deuda, S. de R.L. de C.V.
• Sociedad Limitada de los Activos de Gramercy, S de R.L.
• Sociedad Corporativa para la Resolución de Activos y Propiedad S. de R.L. de C.V.
• SCRAP II, S. de R.L. de C.V.
In working with defaulted loan accounts, our approach is to find a mutually satisfactory resolution based on the current market value of the property that serves as the collateral for the loan. We are prepared to offer alternative means to resolve loans with debtors who have defaulted on their payments, including: a one-time payment, a series of payments over a short period of time, or the restructuring of the terms of payment in the form of a new mortgage loan at prevailing market rates.
Our objective is to work with debtors to find a mutually beneficial solution without resorting to legal actions. However, if debtors are unable or unwilling to reach a satisfactory negotiated solution with us, then we will have no choice but to pursue a recovery through all legal methods available to us, including foreclosure.
Pendulum is committed to running its business under the highest of ethical standards. Our processes are designed to be entirely transparent, and debtors are encouraged to request access to a supervisor if they have any concerns or questions about the procedures being followed by our collection executives or lawyers.
Pendulum is a member of the Mexican Credit Bureau and follows their standards for both reporting debtors in default as well as removing individuals who resolve their debt.
